The Lisbon Treaty provides for sport as a supporting action in a new Art. 6(e) TFEU and 165 TFEU. The EU can make legally binding desicions without harmonising national laws.

In 1995, the EU Court decided (Bosman case) that professional football constituted an economic activity as defined under the EU treaties and was therefore subject to EU laws governing the free movement of workers.
