Electoral threshold 

Members of the European Parliament are elected by electoral law in the member states. However, they must accept the common EU rules for elections. There must thus be less than a minimum threshold of for example 5% of the electorate. 

Germany had a threshold of five percent, which was first reduced to four percent since condemned by the German Constitutional Court.
