Metock case
The European Court of Justice decided in 2008 that third country nationals coming from another EU member state could immigrate into an EU country also when they have no legal permit to stay from the other EU country.
This verdict raised strong criticism against the "activist role" of the European Court in Denmark and some other member states.
The late professor of constitutional law, Hjalte Rasmussen, wrote it was doubtful if this court case could be implemented in Denmark since it was outside the areas of competences handed over to Brussels according to the Danish Constitution Article 20.
